Crossing border with sealed criminal record
Someone I may be taking has been arrested, convicted, and served probation. The records of the case were sealed once probation was finished.
Should this person have any problems crossing the border? If so, would advance contact with the Canadian Government be helpful in getting an exception? Don't worry about it being someone bad, they learned all relevant lessons from the experience and is quite the cool person nowadays. |

Hmm... Not finding much through that site or further googling... What I have found suggests there are some changes to the procedures if its sealed, or if its a youth conviction(both apply in this case), but as far as exactly how things change, I haven't found anything.
A few specifics... Two misdemeanor charges at the same trial, both convictions, youth offender, records sealed when my friend turned 21, its been about 7 years since the conviction, a little under 5 since the sentence ended. This is the extent of my friends criminal record. I mention this because what I have found shows that the class of crime, and time since, does have a part in whether or not you are allowed in... I do have some more information about the case, but I'd prefer not to give any more specifics for obvious privacy reasons, my friend has let me say this much but I'm not going to reveal any more unless I have to call the consulate about it and they ask. i had a friend from mass who couldn't get through last year for wemf because he had a criminal record. best bet is to try and get it expunged

Frolic- Looked throught that link you gave a bit more, she was a youthful offender, which is an exemption to the restrictions. Thanks!

yep, i have a small record from when i was a minor, just a misdemeanor...and i have never had an issue :P i feel retarded even saying this hahaa
but the point is it should be fine haha

not proud of it but i was arrested for something really stupid that wasn't even a crime that was completely news to me..and had to pay a grand in ticket/court costs/lawyer fees....eeek

a friend of mine recently tried to get across the border and was denied the record was old and supposedly expunged, either way it was definetly a misdermenor and he had forgotten about it. when asked if he had a record he said no. they called him on it. he explained he forgot. he was denied. the customs guy said had he been honest they would have let him in
take it for what its worth |
